Two people were sentenced recently on felony charges in Southeast District Court in Jamestown.
Tanner Wayne Baumgardner, 25, Drake, N.D., pleaded guilty to two counts of possession of drug paraphernalia, Class C felonies, ingesting a controlled substance, a Class A misdemeanor, and two counts of possession of drug paraphernalia, ingesting a controlled substance and possession of a controlled substance, marijuana, Class B misdemeanors.
Baumgardner was accused of possessing a glass pipe intended for use with methamphetamine on Nov. 14 and Dec. 1 with previous convictions for similar crimes in 2014 and 2017. He was also accused of possessing methamphetamine, marijuana and smoking devices used with marijuana on Nov. 14 and Dec. 1, and ingesting a controlled substance on Nov. 14 in Stutsman County.
Judge Cherie Clark sentenced Baumgardner to 20 days in the Stutsman County Correctional Center with credit for 20 days served. Baumgardner was placed on 18 months supervised probation and placed on the 24/7 Sobriety Program. As a condition of his probation, he must complete a diagnostic assessment and any recommended treatment
Baumgardner was ordered to pay a $400 criminal administration fee, $100 defense/facility administration fee, $35 indigent defense application fee and $25 victim-witness fee.
A Class C felony is punishable by five years in prison and a $10,000 fine. A Class A misdemeanor is punishable by one year in prison and $3,000 fine. A Class B misdemeanor is punishable by 30 days in jail and a $1,500 fine.
Bryce Wayne Iron Hawk, 26, James River Correctional Center, pleaded guilty to four counts of contact by bodily fluid or excrement, Class C felonies, and criminal mischief, a Class B misdemeanor.
Iron Hawk was accused of throwing feces at four officers of the James River Correctional Center and damaging Correctional Center property with feces on June 17.
Clark sentenced Iron Hawk to five years in the North Dakota Department of Corrections and Rehabilitation with credit for 185 days served to be served concurrently with previous charges.
Iron Hawk was placed on 18 months supervised probation and ordered to pay a $400 criminal administration fee, $100 defense/facility administration fee, $35 indigent defense application fee, $568 restitution and $25 victim-witness fee.
