    Abusive drunk physician tries to operate

    Dr. Federico Castro-Moure, chief neurosurgeon at Highland Hospital in Oakland, California, is included here for having said, “Do you know that I am a (expletive) doctor, and I’m going to do what I want” according the The Oakland Tribune. Doctors too routinely are allowed to do what they want without anyone stopping them or reporting them or doing anything but defending them. That they are used to having that much power and protection surfaces from time to time in statements like that and the behavior of others on this list of examples.

    No group of human beings can be trusted blindly with that much power. It leads even to the commissions of crimes against helpless patients. Crimes are the tip of the iceberg – a revealing tip that we are kept from seeing. In this case, he wasn’t committing a crime. Driving while drunk is a crime, but operating while drunk is not. They did not call the police because he was drunk. Normally inebriated surgeons are not discouraged from operating. They don’t call the police to protect patients from possibly being injured by an inebriated surgeon. These staff didn’t call the police until they worried he was going to hurt a nurse. Sometimes they will protect their own.

    In the newspaper it said that Dr. Casto-Moure was on call when there arrived a patient who had fallen two stories and landed on his feet. Casto-Moure wanted to operate immediately but was told the instruments would have to be sterilized first. He threw fit, yelling and swearing at staff, telling them “he didn’t (expletive) care what hospital procedure was.” The charge nurse refused to admit the patient into the operating room until the instruments were re-sterilized. Casto-Moure began punching his fist into his hand while walking toward the nurse. Sheriff deputies at the hospital were called. When they arrived Castro-Moure screamed at them, “What the (expletive) do you want? . . I am a (expletive) doctor, and I’m going to do what I want.”

    They tried to calm him down, but he shoved one officer and took a swing at another. Deputies wrestled him to the ground, handcuffed him and put him under arrest.

    If he hadn’t threatened a nurse, hospital staff normally would have allowed him to operate and, even if the patient ended up with life-ruining injuries, no one ever would have found out that the surgeon had been drunk. They don’t make records of things like that in medicine.

    But he struggled with the police

    So it made the news. Has the doctor ever operated while under the influence before? How would anyone know? Who would tell?

    We need for patients, if no one else, not just to be allowed to report what happens to them in medicine, but to see that they have a duty to do that to protect other patients. We need a mechanism set up that encourages their reporting, and that encourages hospital staff and others to report as well. State patients boards could do that if they existed. At least they could provide a single phone number for all complaints about healthcare so people at least would know a number to call. The way things are now hospital staff wait for things to reach a level that requires the intervention of the police to protect other staff members. If there were one phone number everyone knew to call, perhaps they would call a bit sooner.

    But, of course, the way things are now, people who report problems in medicine can be sued or fired or blacklisted for having done so. We need state patients boards to try to arrange for them to be able to report without that happening.

    The top neurosurgeon at Highland Hospital has been suspended and may be charged with a misdemeanor after what authorities called a drunken altercation with sheriff’s deputies in an operating room, officials said today.
    Deputies believe Dr. Federico Castro-Moure, 45, was intoxicated during the scuffle and prosecutors may charge him with public drunkenness and interfering with a peace officer.
    “The deputies felt that he was behaving in an aggressive manner,” Alameda County Sheriff’s Capt. William Eskridge said. “He was yelling and put a fist in the face of a deputy in a threatening manner.”

    The incident began about 8:30 p.m. Monday when Castro-Moure argued with nurses recommending that he wait several hours for sterile equipment to arrive before operating on a spinal patient.
    Although Castro-Moure wanted to operate immediately, other hospital personnel believed the surgery could be delayed because the patient was stable enough to wait, said Dr. David Altman, the hospital’s chief medical officer.In such cases, it is the hospital’s policy to wait. But Castro-Moure became angry and physically and verbally abusive, officials said. A nurse summoned deputies to the foyer outside the fifth-floor operating room.
    When deputies attempted to intervene, Castro-Moure allegedly shouted obscenities and used his arm and clenched fist to keep them at bay, officials said.Although the deputies arrested Castro-Moure on suspicion of public intoxication — based upon both his behavior and the smell of alcohol on his breath — Eskridge said the doctor was so uncooperative that deputies could not adequately test him for intoxication.
    “He compromised the test by not blowing the amount of time the test needs to get an accurate reading, but the device did indicate there was some alcohol in his system,” Eskridge said.
    The unidentified patient was in the emergency room at the time and remained there throughout the incident, officials said. His spinal operation occurred Tuesday morning, and he is recovering satisfactorily, Altman said.
    Altman announced Thursday that Castro-Moure has been suspended without pay. Castro-Moure, Highland’s head of neurosurgery since 2003, will be barred indefinitely from practicing at the hospital pending several investigations by the hospital and county health officials, Altman said.
    The California Medical Board, which holds licensing power over all doctors in the state, is expected to launch its own investigation of Castro-Moure. The board could potentially strip him of the ability to practice medicine in the state.
    “I cannot confirm or deny that we have an investigation because that is not a public record,” said Erlinda Suarez, analyst California Medical Board.
    “But I can tell you that in any case like this with wide media coverage we would probably initiate an investigation based on media reports,” Suarez said.
    Altman said Alameda County Medical Center officials are “very concerned.”
    Although there is no specific policy banning alcohol consumption by doctors before surgery, Altman said doctors and other employees are barred from working when “impaired in any way by drugs or alcohol.”
    He also said it is hospital policy to immediately report any person with alcohol on their breath.
    “We will not tolerate unprofessional conduct that could endanger our patients,” Altman sad. “That is unacceptable.”
    Castro-Moure has been at Highland Hospital since November 1999 and had no history of misconduct, Altman said.
    Castro-Moure received his medical degree from Collegio Mayor de Nuestra Senora del Rosario in Bogota, Colombia, and his doctorate from Wayne State University in Detroit.
    “He is a well-respected neurosurgeon, well respected in his field,” Altman said.

    Castro-Moure became belligerent after insisting on operating on a man who broke his ankles and fractured his spine in a two-story fall, according to the sheriff’s department.

    Two other surgeons had determined the injuries were not life-threatening, but Castro-Moure insisted the man would die if he did not receive immediate attention, the report said.

    He “threw a fit” and began yelling and cursing at staff when they told him equipment for the procedure needed to be transferred from another hospital, according to the report. When the surgical instruments arrived, a nurse refused to allow Castro-Moure to operate until they could be sterilized.
    Castro-Moure threatened the nurse by punching his fist in his hand.

    He took a swing at deputies after they were called to intervene. “Do you know that I am a (expletive) doctor, and I’m going to do what I want,” he said, according to a witness.

    He was booked into Glenn Dyer Detention Facility in Oakland and was released several hours later in lieu of $4,000 bail, a jail official said Thursday morning.
    Castro-Moure was placed on leave while the hospital investigates the matter, hospital spokesman David Cone said.

    A woman who answered the phone at Castro-Moure’s home Thursday morning said the doctor had no comment.

OAKLAND — A drunk Dr. Frederico Castro-Moure, chief of neurosurgery at Highland Hospital Oakland, was arrested Monday night after getting combative in an operating room and later taking a swing at officers, according to the Alameda County Sheriff’s Department.

    Castro-Moure was arrested just after 8:30 p.m. by sheriff’s deputies for being under the influence of alcohol and interfering with the duty of officers, according to a Sheriff’s Department report.

    Deputies believed the doctor was drunk beyond the ability to care for himself and others, Lt. Jim Knudson said.

    The doctor could not be reached for comment Wednesday.

    According to a witness who gave authorities details of the incident, Castro-Moure’s angry tirade started when hospital staff questioned his medical authority.

    The doctor was on call when Highland received a trauma patient who had fallen two stories and landed on his feet, the witness said. The patient fractured both ankles and suffered a compression fracture to his spine but was coherent and talking.

    The patient was referred to Castro-Moure after meeting with a trauma surgeon and an orthopedic surgeon at thehospital, both of whom determined his injuries were not life-threatening, the witness said.

    Casto-Moure wanted to operate immediately but was told the necessary medical implants and surgical instruments had to be ordered from another hospital and would have to be sterilized — a two-hour process — as per hospital procedure.

    The doctor then threw a “huge fit,” according to the witness. He began yelling and swearing at staff, telling them “he didn’t (expletive) care what hospital procedure was, he needed to get this patient to surgery or else he would lose his life.”When a wrapped tray of sterile surgical instruments arrived from another hospital, the charge nurse refused to admit the patient into the operating room until the instruments were re-sterilized, the witness said.

    The doctor lost his temper again and began intimidating the charge nurse by punching his fist into his hand while walking toward her, according to the witness.

    The nurse walked away, but when it appeared the doctor would follow her into a private locker room, someone on staff alerted sheriff’s deputies at the hospital to the situation.

    When deputies arrived at the operating room on the hospital’s fifth floor, Castro-Moure came around the corner.

    “What the (expletive) do you want?” he screamed at the deputies, one witness reported.

    “Do you know that I am a (expletive) doctor, and I’m going to do what I want,” he said, according to the witness.

    The officers tried to calm the doctor, but Castro-Moure resisted, deputies reported. He shoved one officer and took a swing at another.

    Deputies said they had to wrestle the doctor to the ground to handcuff him.

    Castro-Moure was booked at Glenn Dyer (North County) Jail in Oakland and released on bail.

    Highland Hospital spokesman David Cohen said Wednesday that Castro-Moure has been placed on leave while the hospital investigates the matter. The hospital is taking the allegations very seriously, he said.

    “We are committed to upholding the highest standards of professionalism in our physicians and other caregivers and hospital staff and to providing outstanding health care services,” Cohen said.

    Although David Altman, the hospital’s chief medical officer said, “He is a well-respected neurosurgeon, well respected in his field,” this quote did not get picked up by many media sources. However, the negative allegations were repeated. On April 7th, 2006 the San Francisco Chronicle reported that the allegations where cleared and Castro-Moure’s medical license restored. But will his reputation be forever besmirched?
    A couple of words of warning when dealing with the media. You can see that making just one mistake can ruin your life pretty quickly if it’s broadcast nationwide. Same with your words. Once they’ve left your lips they are fair game to be re-printed ad-nauseum. Of course there will always be situations you’re unprepared for, but thinking about the consequences can make you get savvy quite fast.
