The trial of former NBA player and Auburn assistant coach Chuck Person will go on as scheduled, a federal judge in New York ruled Thursday, AL.com reported .
A federal grand jury indicted Person in November 2017 for his alleged role in illegal recruiting in college basketball. Former NBA referee Rashan Michel was also indicted as part of the FBI’s investigation into corruption in the sport. Both Person and Michel have pleaded not guilty.
Person, who will stand trial June 17, according to The New York Times , requested a dismissal of charges in March and July of 2018, saying the government’s case was “ deeply flawed .”
Person and Michel face charges of conspiracy to commit bribery, conspiracy to commit honest services wire fraud, wire fraud conspiracy and Travel Act conspiracy. Person also is charged with solicitation of bribes and gratuities by an agent of a federally funded organization.
Auburn initially suspended Person without pay in September 2017 after he was arrested on the six felony charges in the “pay-for-play” scheme. He was fired by the school following his indictment.
According to the indictment , Person and Michel “participated in a scheme whereby bribes were solicited from and paid by a financial advisor and business manager to Person … and such bribe payments were facilitated by Michel. In exchange for the bribes, Person agreed to exert, and did exert, his influence over student-athletes under his control to retain the services of the bribe-payers once the athletes eventually entered the National Basketball Association.”
Person, a former star at Auburn, played 13 seasons in the NBA before retiring in 2000.
